Terms of Service

These Terms of Service ("Terms") govern your use of the Tote-ally Unboxed website and your booking of our reusable tote rental service. By using this site or submitting a booking request, you agree to these Terms. If you don't agree, please don't use the site.

1Who we are

Tote-ally Unboxed LLC is an Illinois limited liability company that rents reusable moving totes, rolling dollies, and related supplies to customers in the Plainfield, Illinois area and surrounding communities. Throughout these Terms, "we," "us," and "our" refer to Tote-ally Unboxed LLC, and "you" refers to the person using our site or renting from us.

2Eligibility

You must be at least 18 years old and able to enter into a binding contract to rent from us. By booking, you confirm that the information you provide is accurate and that you are authorized to use the payment method you supply.

3Booking requests are not confirmed reservations

Submitting the booking form on our website creates a request, not a guaranteed reservation. Equipment availability is limited and changes constantly.

Your rental is confirmed only when we contact you to confirm your dates and send an invoice. Until then:

• We may be unable to fulfill your requested dates or package
• We may need to offer alternative dates or a different package size
• Totals shown on the website are estimates and may be adjusted before invoicing

4Service area

Free delivery and pickup apply within our published service area. If your address falls outside that area, we may decline the booking or quote an additional travel charge before confirming. We'll always tell you before you're invoiced.

5Pricing and payment

• Prices listed on the website are current at the time of posting and may change at any time. The price we confirm on your invoice is the price that applies to your rental.
• Payment is made through a Square invoice we send you. Your rental is reserved once payment (or the deposit we specify) is received.
• As described in the Rental Agreement, you authorize us to keep a payment card on file and to charge it for the rental and for any applicable extension, trip, cleaning, or replacement fees.
• You are responsible for any applicable taxes.

6Changes, cancellations, and late returns

• Changes and cancellations: contact us as early as possible. We'll do our best to accommodate changes based on availability.
• Extensions: must be requested at least 24 hours before your scheduled pickup and are billed at our published extra-week rate, subject to availability.
• Missed pickups: if equipment isn't accessible and ready at the agreed window, a trip/rescheduling fee applies and rental charges continue until we retrieve it.
• Our right to cancel: we may cancel or refuse service if equipment is unavailable, the address is unsafe or unreachable, payment fails, or these Terms or the Rental Agreement are violated. If we cancel for reasons within our control, we'll refund amounts you've paid for that rental.

7Your responsibilities with the equipment

The Rental Agreement sets out the full requirements — including weight limits, prohibited items, cleaning and return condition, and the replacement fee schedule. You agree to those terms when you book. In short: keep the equipment safe, don't overload it, don't put hazardous materials in it, and return it clean, empty, and accessible.

8Use of this website

You agree not to:

• Submit false, fraudulent, or automated booking requests
• Attempt to disrupt, damage, probe, or gain unauthorized access to the site or its systems
• Copy, scrape, or reuse site content except as allowed below
• Use the site for any unlawful purpose

9Our content and brand

The Tote-ally Unboxed name, logo, photographs, written content, and site design are our property or used with permission, and are protected by intellectual property laws. You may view and print pages for your own personal, non-commercial use. You may not reproduce, republish, or use our branding or content commercially without our written permission.

10Digital products

We also sell digital guides and downloadable materials. Those purchases are governed by our Digital Products: Delivery & Refund Policy, which covers delivery, refunds, and how you're licensed to use them.

11Disclaimers

The website is provided "as is." While we work to keep information accurate and the site available, we don't warrant that it will be error-free, uninterrupted, or that every listed price, package, or date will be available.

Our equipment is rented "as is." Heavy-duty plastic totes offer strong protection compared to cardboard, but we do not guarantee your belongings against drop damage, moisture, improper packing, or improper stacking. You are responsible for how you pack and handle items inside the totes.

12Limitation of liability

To the fullest extent permitted by law, Tote-ally Unboxed LLC is not liable for indirect, incidental, special, or consequential damages, or for lost profits, moving delays, or damage to items packed inside the equipment. We are also not liable for personal injury or property damage occurring during your own packing, lifting, rolling, loading, or transportation of the equipment, or that of your movers or helpers.

Where liability cannot be excluded, our total liability arising out of a rental is limited to the amount you paid us for that rental.

13Indemnification

You agree to indemnify and hold harmless Tote-ally Unboxed LLC from claims, damages, and reasonable expenses arising out of your use of the equipment, your violation of these Terms or the Rental Agreement, or your violation of any law or third-party right.

14Governing law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Will County, Illinois, and you consent to that jurisdiction.

15Changes to these Terms

We may update these Terms as our business changes. Updates take effect when posted, and we'll revise the "Last updated" date above. The Terms in effect at the time of your booking apply to that rental.
